TERMS AND CONDITIONS OF RENTAL FOR THE UNITED STATES

  1. Contract. 

The Terms and Conditions of TIXE Car Rental, any additional agreement signed by you, the privacy notice, the terms of use, the rental documents, and a return record that includes a calculation of the rental charges. All these constitute the rental agreement between you and TIXE Car Rental LLC.

  1. General Information.

The rental document describes the vehicle rental, where a rental is solely a mutually beneficial agreement. You agree to the following terms, understanding that such terms do not contravene the laws of the jurisdiction where this rental is entered into, in which case such laws govern it. “You” and “your” refer to the person signing the Contract; “we,” “us,” and “our” refer to TIXE. You also acknowledge that you are not our agent for any purpose and that you may not assign or transfer your obligations.

  1. Changes.

Any changes to the Contract or our rights must be made in writing and signed by an authorized officer of TIXE. Additionally, you agree that we have the right to change these Terms and Conditions from time to time, in which case we will send you a written notice, in printed or electronic format, or by posting such changes on the TIXE website. Such changes will apply to rentals that you reserve after such notice has been given, as indicated by the date of such notice if sent in written form, or by the date on which such changes are posted on the TIXE website, in which case the date on which such changes were incorporated will be indicated, without any requirement on your part to sign the modified Terms and Conditions. Changes to the Terms and Conditions will be posted as they occur on the TIXE website at www.tixecr.com and will govern all rentals, even if the terms in effect at the time of the subscription are different.

  1. “Vehicle” meaning.

The word “vehicle” refers to the vehicle you rented or its replacements, and includes the tires, tools, equipment, accessories, license plates, and documents, unless explicitly stated otherwise in the contract.

  1. Who can drive the Vehicle?

You declare you are qualified to drive and possess a valid driver’s license. You agree that we have the right to verify that your license has been issued validly and is in good standing as a precondition to each rental; at our sole discretion, we may refuse to rent a vehicle to you if your license has been suspended, or revoked, or carries any restrictions. We reserve the right to refuse to rent a vehicle to you based on information about the status of your license, the authenticity of the credential, or the driving history provided by the Department of Motor Vehicle (DMV) of the jurisdiction that issued the license or any other reliable source responsible for validating an identity or driver’s license credential. We reserve the right to periodically validate your driving credentials. Except where explicitly authorized by applicable laws, only you, your spouse, or domestic partner may drive the vehicle; or, if you rent one of our vehicles under an employer’s corporate account agreement, only you, as an employee, your employer, or an employee who incidentally shares work responsibilities related to the business operation may drive the vehicle, but only with your prior authorization. The driver must be at least 25 years old, qualified to drive, and possess a valid driver’s license. An additional driver charge may apply for each authorized additional driver, or in the case where the driver does not meet the required age, as specified in the rental document.

  1. Vehicle Return.

You agree to return the vehicle in the same condition as received, except for normal wear and tear, on the date, time, and at the specified office stated in the rental document. You must return it earlier if requested. If returned late (after the grace period), a full day will be charged. You may not return the vehicle outside the office’s operating hours. If you do so, your liability for damages or loss of the vehicle will remain, and all charges specified in the rental document as a periodic rate will continue to accrue until the office reopens and we regain effective possession of the vehicle.

Office hours vary by location. If the vehicle is not found when the office opens, your liability for all charges, damages, or loss of the vehicle will continue until the vehicle is effectively returned or recovered. If you wish to extend a rental, you must contact us at +1-973-607-4475 or use another approved method of contact to make the corresponding request before your return date. We reserve the right, at our sole discretion, to grant or refuse the extension of the rental for the requested period. If we do grant an extension of the rental period, a different or higher fee may apply to the extension period, as well as a service fee.

  1. Where to return the Vehicle.

The vehicle must be returned to the agreed rental office as specified in the rental document. If a different return office is indicated than the office where the rental was initiated, you may be required to pay a “one-way service fee.” If you return the vehicle to a different office than the agreed return office without our permission, you agree to pay an “unauthorized return office charge” specified by us.

  1. Rental Charges:

You will be charged based on the number of miles/kilometers you drive and the rental period specified in the rental agreement, or the applicable corporate rate. The minimum charge is one day (24 hours) unless specified as a “calendar day” in the rental agreement, plus mileage or a fixed rate. We will determine the miles/kilometers by reading the odometer installed in the vehicle or using the vehicle’s telematics device. The daily charge applies to consecutive periods of 24 hours, starting from the rental start time and a minute or, if specified as a calendar day in the rental agreement, to each consecutive calendar day or fraction thereof, starting from the calendar day the rental begins. If you do not meet any of the specified conditions for special rates in the rental agreement, additional applicable fees will be added to the billing amount, as appropriate.

You will pay all charges applicable to the rental for miscellaneous services and, where permitted, airport fees and/or concession recovery fees, vehicle license recovery fees, other fees, and other surcharges.

  • If you present reward certificates, coupons, or vouchers associated with a loyalty rewards program, you may be required to pay a redemption fee. Additionally, if you choose to earn airline miles or other benefits from comparable loyalty programs, you may be required to pay a fee.
  • You will also pay a reasonable fee for cleaning the vehicle’s interior upon return if it is excessively dirty, stained, or has an unpleasant odor due to vehicle use, as determined by us.
  • If the key(s) is not returned with the vehicle, you may be charged an additional fee.
  • We have a non-smoking fleet, including the use of electronic cigarettes. You will be charged an additional fee if you return the vehicle with a cigarette odor.
  • You and any third party billed for the rental charges, such as an insurer or employer, are jointly and severally responsible for the payment of all such charges. By instructing us to bill such charges to a third party, you are representing that you are authorized to make such a request.
  • If you use a vehicle with an automatic toll payment function, please refer to the notifications in our “e-Toll” paragraph below.
  • To the extent that you use a discount code for a rate or benefit related to a rental, you represent that you meet the requirements for using such a discount code.

Any other use will be deemed unlawful and theft of the services for which TIXE may take legal action, including but not limited to reasonable attorney fees and costs, and may void any associated rental discount or benefit.

  1.  Taxes, Surcharges, and Fees:

You will also pay all applicable taxes, as well as additional charges included in the rental documents that are supplementary to the base rental rate. These may include surcharges and other recovery fees intended to recover certain costs.

  1. Reservation with a Card:

You acknowledge that you have been informed that if you use a payment card, your credit, up to an amount equal to the estimated total charges you owe under this Agreement, as indicated in the rental document and based on the information you provided about this rental, may be authorized or reserved by the card issuer presented for payment of rental charges. Alternatively, if you use a debit card, the funds in the associated account may be held in an amount that is the greater of the estimated total charges owed under this Agreement, based on the information you provided about this rental as indicated in the rental document, or the deposit amount stated on the signs at the rental office at the time of rental. You agree that this total estimated amount will be reserved at the start of the rental. You understand that we will authorize or release any excess of the reservation at the end of your rental, and the rules of your card issuer will apply to your credit line or the account to which such excess is credited, and that such credited amount may not be immediately released by your card issuer.

  1. Vehicle Recovery:

We may recover the vehicle at any time, at our sole discretion, for reasons including, but not limited to, the following: it is found parked illegally, it is used to violate the law or the terms of the Agreement, or it is abandoned. You agree that we are not obligated to notify you in advance. In the event the vehicle is recovered, you agree to pay the actual and reasonable costs incurred by us for such recovery. You agree that such costs will be charged to the card you used to rent the vehicle.

  1. Use of Personal Insurance:

You acknowledge that you have been informed that your personal insurance may cover the loss or damage to the vehicle. You also confirm that you have read the notice regarding loss and damage contained in the rental document or these Terms and Conditions, or a separate notice form.

NOTICE OF RIGHT TO DAMAGE INSPECTION

If the vehicle is damaged, we may not be able to collect any amount for the damages unless you or an authorized driver we deem responsible have been promptly notified of your right and your insurer’s right to inspect the unrepaired vehicle within two business days after we were notified of the damages. Upon request, we must also provide you with a copy of the estimated amount we have received from a repair shop regarding the damage claim. Within two business days of receiving the estimated amount, you may request a second estimated quote from another repair shop, and we must provide you with a copy of the second estimated amount.

  1. Prohibited Use of the Vehicle:

Certain uses of the vehicle and certain practices that you or the driver of the vehicle may engage in, or responsibilities that you may fail to fulfill, will be considered a violation of this Agreement and, in addition to any other measures, may result in the cancellation of your contract. A violation of this paragraph will automatically terminate your rental and constitute a waiver and nullification of any liability coverage and any optional services you have accepted, including but not limited to additional liability insurance, personal accident insurance, personal effects protection, extended roadside assistance, emergency sickness protection, and loss or damage waiver or partial damage waiver. In addition, you shall be held responsible to us for all penalties, fines, forfeitures, liens, and recovery and storage costs, including all expenses, fees, and legal costs incurred by us. You commit a violation of this paragraph if:

You use or allow the vehicle to be used:

  • By a person other than the authorized driver as defined in Clause 5;
  • To transport passengers or property for hire;
  • To tow or push any object;
  • To operate in a test, competition, or contest, or on unpaved roads;
  • While the driver is under the influence of alcohol and/or other controlled substances and/or otherwise impaired;
  • To engage in conduct that could be considered illegal or in violation of regulations, including the transportation of a controlled substance or contraband goods or devices;
  • If driven recklessly or while overloading;
  • If the vehicle is driven in Mexico without our express permission.

You or an additional driver authorized or not:

  • Fail to promptly report any damage or loss of the vehicle when it occurs, or when you become aware of such occurrence, and provide us with a written report of the accident or incident or fail to cooperate in our investigation;
  • Where required by law, fail to report the accident to the appropriate law enforcement authorities;
  • Obtain the vehicle through fraud or by providing false or incorrect information;
  • Leave the vehicle unattended and fail to remove the keys or fail to close and lock all doors, close all windows and the trunk, and the vehicle is stolen or subjected to vandalism;
  • Cause or allow the vehicle to be intentionally damaged or damaged due to willful negligence, or
  • Return the vehicle after the office closing hours and if the vehicle is damaged, stolen, or subjected to vandalism, or if fails to take reasonable steps to secure the vehicle, keys, or other remote entry and starting devices.

Driving or operating this vehicle while using a handheld wireless communication device or other device capable of receiving or transmitting phone calls, electronic data, email, or text messages will be considered a breach of this agreement.

  1. Fuel Service Charge:

While most vehicles are rented with a full tank of fuel, this is only sometimes the case.

If available and permitted by law, if you drive less than 75 miles, you agree that we will add a flat fee to the rental, the amount of which will be disclosed on the rental agreement and at the counter before rental. You can avoid this charge at the time of return by providing a fuel receipt. The flat fee will be reversed from your total rental charges at that time. If subparagraph (a) does not apply, there are three refueling options:

  • If you decline the fuel service option, if available, at the start of the rental and return the vehicle with less fuel than when you received it, we will charge you a refueling service fee at the applicable per mile or gallon rate stated on the rental agreement or provided at the counter. The per-mile rate is used if you did not purchase fuel during the rental period. To calculate this amount, we multiply the number of miles driven as indicated by the vehicle’s odometer (or provided by the vehicle’s telematics device) by the per-mile rate stated on the rental agreement. The per gallon rate is used if you purchase fuel during the rental and provide us with the receipt when requested, but the tank is not as full at the time of return as when you received the vehicle (determined by a factory-installed gauge, rounded to the nearest lower eighth of the tank), at the per gallon rate listed on the rental agreement. Although two methods are used to facilitate calculation, the per mile and per gallon rates yield approximately the same result. Some of our vehicles are equipped with onboard telematics devices that record the actual amounts of fuel in the gas tank. If your vehicle is equipped with such a device, you will be charged the actual amount of gasoline needed to fill the tank based on the reading from this device.
  • If you accept the fuel service option at the beginning of your rental, you will be charged the amount shown on the rental agreement for that purchase and will not be charged a fuel service fee. By choosing this option, you will not have to pay additional charges for fuel and service, but you will not receive any credit for the fuel in the tank upon returning the vehicle. The per gallon cost of the fuel service option will always be lower than the fuel service fee. The cost of refueling the vehicle by the customer at a local gas station is generally less than the fuel and service fee or the fuel service option. You acknowledge that the fuel service charge is not a retail sale of fuel.
  • You can avoid a fuel service charge by returning the vehicle with a full tank of fuel at the same level as when you received it and, if requested, presenting a fuel purchase receipt.
  1. e-Toll.

If you do not pay tolls in cash or cash payments are not accepted on the road, you automatically accept our e-Toll service, through which you agree to pay us or pay our toll program administrator, with whom we will share your credit/debit card information, for all tolls incurred during your rental and all related fees, charges, and penalties. In the e-Toll program, when you pass through an electronic toll, you will be charged a service fee of $3.95 per day for the entire rental period, including any day on which you do not use e-Toll, up to a maximum of $19.75 per rental month, plus toll payments incurred at the current maximum rates published by the toll authority. To avoid the service fee and any other charges, pay the toll in cash, use your own electronic toll collection device, or avoid any toll roads or passages. Charges may take 4 to 8 weeks to be billed to your credit/debit card on file after the rental.

  1. Fines, Expenses, Costs, and Administrative Charges.

You will be responsible for paying all fines, penalties, and court costs related to parking, traffic, toll violations, and other offenses, including liens and storage fees. You will also be responsible for a reasonable administrative charge regarding any Contract violation, such as vehicle recovery for any reason. You agree that we, at our sole discretion, may pay all tickets, citations, fines, and penalties on your behalf directly to the appropriate authority, and you will reimburse us for the amount paid to the relevant authority or their designated agents, plus a reasonable administrative charge. You agree and acknowledge that we will cooperate with all federal, state/provincial, county, and local officials responsible for enforcing these violations, for which we will provide any necessary information they may request or otherwise require.

  1. Roadside Assistance.

Roadside assistance is available to all customers. In some cases, you may purchase additional coverage with extended roadside assistance to cover potential costs associated with lost keys, key fob replacement, vehicle lockout, flat tires, towing (if the vehicle becomes inoperable), jump-start, and emergency fuel supply (up to 3 gallons). If you do not purchase extended roadside assistance in advance, you may incur additional costs for providing the aforementioned services. By prepaying for extended roadside assistance, you will be charged on a full or partial daily basis.
